Terms of Service

The Service

CuteMarkets provides developers and businesses with programmatic access to U.S. stocks and listed options market data, including REST API access, optional WebSocket streaming, and related tools, under the plans and limits described on our Pricing page and in your account. Stocks, options, and streaming access may be sold as separate products or tiers. Features such as real-time versus delayed data, product access, credit allowances, and rate limits depend on your subscription tier. We may add, change, or retire features with reasonable notice where practicable.

Accounts and API keys

You must provide accurate registration information and keep it up to date. You are responsible for all activity under your account and for safeguarding your credentials and API keys. Do not share API keys in public repositories or with parties you do not trust. Notify us promptly at hello@cutemarkets.com if you suspect unauthorized use.

Acceptable use

You agree not to:

• Use the Service in violation of applicable law or third-party rights
• Attempt to probe, scan, or test the vulnerability of our systems without authorization, or bypass rate limits or technical restrictions except as we expressly permit
• Use the Service to distribute malware, send spam, or interfere with other users or networks
• Resell, sublicense, or redistribute the Service or bulk data access to third parties except as allowed by your plan and our written agreement
• Misrepresent the source of data or use the Service in a way that could harm our reputation or violate exchange or data-vendor rules we are bound by

We may suspend or terminate access if we reasonably believe you have breached these rules or pose a risk to the Service or others.

Fees and plans

Paid plans, billing cycles, and usage (including API credits) are as shown at signup or checkout and in your dashboard. Unless stated otherwise, fees are non-refundable except where required by law. We may change prices or plan limits for future billing periods with advance notice. Failure to pay may result in downgrade or suspension of paid features.

Intellectual property

We and our licensors retain all rights in the Service, software, branding, and documentation. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Service for your internal business or personal development purposes in line with your plan. Market data remains subject to applicable exchange and vendor rules; you may not use it in ways that exceed what your subscription and the law allow.

Market data disclaimer

Data made available through the Service is for informational purposes only. It is not investment, tax, or legal advice. Trading involves risk; you are solely responsible for your decisions. We do not guarantee uninterrupted, error-free, or real-time delivery on every tier, availability, latency, and freshness depend on your plan, market conditions, and maintenance.

We strive for accuracy but do not warrant that data is complete or free of errors. You should verify critical values independently before relying on them for trading or compliance.

Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

Limitation of liability

To the fullest extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Service, even if we have been advised of the possibility of such damages.

Our total liability for any claim arising out of or relating to the Service or these Terms is limited to the greater of (a) the amount you paid us for the Service in the twelve months before the claim or (b) fifty euros (€50), except where liability cannot be limited by law (for example, gross negligence or intentional misconduct, or mandatory consumer rights).

Indemnity

You will defend and indemnify us against third-party claims, damages, and costs (including reasonable legal fees) arising from your misuse of the Service, your violation of these Terms, or your violation of others' rights, except to the extent caused by our willful misconduct.

Termination

You may stop using the Service at any time. We may suspend or terminate your access if you materially breach these Terms, if we must comply with law, or if we wind down the Service with reasonable notice. Provisions that by their nature should survive (including disclaimers, limitations of liability, and indemnity) will survive termination.

Changes

We may update these Terms from time to time. We will post the revised version on this page and update the "Last updated" date. Material changes may be communicated by email or an in-product notice. Continued use after changes take effect constitutes acceptance unless applicable law requires a different process.

Governing law

These Terms are governed by the laws of Germany, excluding conflict-of-law rules. If you are a consumer with mandatory protections in your country of residence, those remain unaffected. Exclusive place of jurisdiction for disputes with merchants (Unternehmer) is Munich, Germany, where permitted by law.
